It is being reported that Chris Brown’s attorney Mark Geragos is looking to get the alleged beating case dismissed based on the leaked photo of a severely battered Rihanna. E! News reports that Los Angeles Superior Court Judge Patricia Schnegg today set a preliminary hearing for May 28th on Chris Brown’s double felony case.

Apparently, his lawyer is pushing for as late a court date as possible to provide him enough time to respond to the still-pending investigation into just how Rihanna’s police photo was released. If it is proven that the leaked photo was the result of a police transgression, Geragos has revealed that he will move to have the singer’s entire case dismissed. He is quoted as saying:
“The leaks can form the basis for a motion to dismiss the case in regards to outrageous governmental misconduct”.
Adding to that, throughout the case, his lawyer has been working around the clock to negotiate a plea deal but it seems now that they’re not even fighting for a plea deal anymore. They are fighting for Chris to get off SCOT FREE. No punishment. No consequences. No anything. Chris being a first-time offender was the main basis used for the plea deal. If the case isn’t dismissed or no plea deal is struck and the case goes to trial, the singer could face a maximum of four years and eight months in prison if found guilty. He is currently facing felony charges of assault and making criminal threats.
Neither Rihanna nor Chris were present for today’s hearing. However, the ‘Umbrella’ singer’s interests—and those of her jewelers—were represented in the courtroom. Should next month’s hearing go on as planned, neither Chris nor Rihanna will be required to attend.
